Terms of Service

These Terms of Service (“Terms”) are a contract between you and Bay Web Digital LLC and Jug LLC governing your use of the Footprint mobile application and related services (the “App”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Footprint. By using the App you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You’re responsible for your account and for keeping your login secure. You may sign in with Apple, Google, or email/password. You’re responsible for activity under your account. Notify us at support@footprintapp.earth if you suspect unauthorized use.

3. The service

Footprint lets you track and “claim” places you visit, earn badges, view stats, and optionally connect with friends. Claims, percentages, badges, and similar features are for personal enjoyment and gamification. We don’t guarantee the accuracy of location detection, region boundaries, area calculations, or other geographic data.

4. Acceptable use

You agree not to:

  • break the law or infringe others’ rights;
  • upload content that is illegal, abusive, harassing, hateful, infringing, or obscene;
  • impersonate others, or falsify your location to manipulate claims, stats, or leaderboards;
  • probe, attack, scrape, or disrupt our systems, or circumvent security or rate limits;
  • harass other users or send spam.

We may remove content and suspend or terminate accounts that violate these Terms.

5. Your content

You keep ownership of the photos and content you add (“User Content”). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely to operate and provide the App (for example, showing your photos in your profile or passport, and to friends where you choose to share them). You’re responsible for your User Content and confirm you have the rights to share it. When you make content visible to other users, you allow them to view it within the App as designed.

6. Friends and social features

If you use social features, other users may see information you choose to share (such as your profile, claimed places, and activity), subject to your privacy settings. Be thoughtful about what you share. You can block users and report content.

7. Intellectual property

The App — including its design, software, badges, artwork, and branding — is owned by us or our licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the App. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law.

8. Third-party services

The App relies on third-party services, including Apple, Google, and Supabase. Your use of those services may be subject to their own terms. We’re not responsible for third-party services.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don’t warrant that the App will be uninterrupted, error-free, or accurate. Do not rely on the App for navigation, safety, or emergencies, and always follow local laws and safe practices while traveling.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOTPRINT AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service. Provisions that by their nature should survive termination (e.g., the license for content you already shared, disclaimers, and limitation of liability) will survive.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. You and we agree that any disputes arising from these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

13. Changes to these Terms

We may update these Terms as the App evolves. We’ll revise the “Last updated” date and, for material changes, give notice in the App. Continued use after changes means you accept the updated Terms.

14. Apple App Store

If you download the App from the Apple App Store: these Terms are between you and us, not Apple; Apple is not responsible for the App; and Apple is a third-party beneficiary of these Terms and may enforce them.
